Welcome to Fishtastic ("the App"), a solar-powered IoT-based smart aquaculture water monitoring system with AI integration and a mobile application, developed by researchers at Our Lady of Fatima University to support water quality management for bangus and prawn farms in the Philippines. By accessing or using the App, you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the App. These Terms comply with applicable Philippine laws, including the Data Privacy Act of 2012 (RA 10173).

1. Acceptance of Terms

By downloading, installing, or using the Fishtastic App, you agree to these Terms and any future updates or modifications, which will be communicated via the App, email, or SMS. These Terms form a binding agreement between you and Fishtastic ("we," "us," or "our").

2. Description of Service

Fishtastic provides real-time monitoring of aquaculture water quality through IoT and AI technologies, including:
Real-Time Monitoring: Water quality parameters (dissolved oxygen, pH, temperature, salinity) collected by the YK-100 multi-parameter water quality detector, read via ESP32-S3 camera + OCR pipeline.
Notifications: Push and email alerts for threshold breaches (e.g., "DO below 4 mg/L") and weather forecasts (via Open-Meteo API).
AI-Driven Insights: Predictive recommendations powered by Gemini API, with DeepSeek, Grok, and OpenAI as backups.
User Management: Role-based access for Fishers, Farm Managers, and IT Personnel.
Offline Functionality: Local storage of readings on the ESP32-S3 Micro-SD card during outages, synced to Firebase/MySQL upon reconnection.
The App is tested and deployed in real-world aquaculture sites, including the Multi-Species Marine Hatchery in Barangay Quinawan, Bagac, Bataan, and aligns with ISO 25010 quality standards.

3. Eligibility

To use the App, you must:
Be at least 18 years old or have legal authority to manage aquaculture operations.
Have a registered account (Fisher, Farm Manager, or IT Personnel).
Comply with these Terms and applicable Philippine laws.

4. User Responsibilities

As a User, you agree to:
Provide accurate and up-to-date information during registration.
Secure your account credentials and report unauthorized access to support@fishtastic.ph.
Use the App only for aquaculture monitoring and management in compliance with BFAR standards.
Ensure proper calibration and maintenance of the YK-100 water quality detector.
Maintain stable power and internet (Wi-Fi/broadband) connectivity for continuous monitoring.
Adhere to ethical and legal guidelines under OLFU-IERC approval.

5. Prohibited Conduct

You agree not to:
Reverse-engineer, modify, or tamper with the ESP32-S3 firmware, Firebase/MySQL, or Node.js backend.
Use the App for illegal purposes or to disrupt aquaculture operations.
Interfere with the App (e.g., malware, overloading servers).
Share unauthorized data (e.g., AI predictions, water quality logs).
Use unsupported devices or insecure networks that compromise data.

6. Intellectual Property

All software, content, and designs (React Native frontend, Node.js backend, MySQL/Firebase integration, AI models) are the property of Fishtastic and its licensors. You are granted a limited, non-exclusive license to use the App solely for aquaculture management. Copying, distribution, or derivative works require prior written consent.

7. Data Usage and Privacy

Your use of the App involves processing of personal and non-personal data. See our Privacy Policy for details, including:
Data Collection: User info + YK-100 sensor readings.
Data Security: AES-256 encryption across ESP32-S3, Firebase, Node.js, MySQL.
Data Sharing: Limited to providers (Firebase, Gemini, DeepSeek, Grok, OpenAI, Open-Meteo).
Data Retention: Personal data retained only as necessary, securely deleted after project completion.

8. Third-Party Services

The App integrates:
Firebase & MySQL (cloud storage).
Node.js server (backend operations).
Gemini/DeepSeek/Grok/OpenAI APIs (AI analysis & chatbot).
Open-Meteo API (weather forecasts).
These are governed by their own terms. Temporary disruptions (e.g., API limits) may affect App features.

9. Limitations of Service

Parameters limited to DO, pH, temperature, salinity (not ammonia, microbes, etc.).
AI recommendations require manual implementation.
Internet required for AI/weather; offline mode stores data locally only.
Solar-powered system may be affected by prolonged poor weather (battery backup included).
Sensor accuracy ~5%; AI accuracy ~85% (subject to calibration and conditions).
The App is provided "as is," with no guarantee of uninterrupted service.

10. Liability and Disclaimers

Fishtastic and its developers are not liable for:
Fish losses or economic damage due to misuse, failure to follow AI advice, or uncontrollable events (flooding, pollution).
Interruptions caused by third-party outages, power, or network failures.
Inaccuracies from poor sensor calibration or maintenance.
Users remain responsible for verifying data and following BFAR standards.

11. Termination

Accounts may be suspended or terminated if you:
Violate these Terms.
Misuse data or disrupt the system.
Neglect hardware maintenance or operational compliance.
Upon termination, you must stop using the App; your personal data will be deleted per our Privacy Policy.

12. Modifications to the App

We may update, modify, or discontinue the App at any time. Updates may include ESP32-S3 firmware, React Native enhancements, or AI service changes. We are not liable for losses from such updates.

13. Governing Law

These Terms are governed by Philippine law (including RA 10173). Disputes will be handled in City of San Fernando, Pampanga.

By using the App, you acknowledge that you have read, understood, and agree to these Terms and the Privacy Policy. This App is part of a research project approved by the OLFU Institutional Ethics Review Committee (OLFU-IERC) to advance sustainable aquaculture practices in the Philippines.
